Important seniority check reminder to all Local 505 Fleet Service, GSE, and FAC.
Our Contracts contain, in Article 11, the process of how and when you can protest an error in your seniority. Please be aware that you may ONLY protest the most recent seniority roster.
For Fleet Service this will be the roster published on January 31st and July 31st of each year. For Title II the protest process will be from the roster published on January 31st of each year. Any Member who wishes to file a protest has 30 days from the dates above to file; the protest can only be based on errors from or between those dates.
Many of you will remember we had the “Javits” decision back in 2020 which produced the Integrated Seniority List for the TWU – IAM Association. Joshua Javits from Dispute Resolution Services was appointed as the neutral to assist American Airlines and the Association with the seniority integration because of the AA and US Airways merger. Javits began this task in 2016 and concluded with the final list in 2020, which is the basis for our current historical seniority lists. Between 2016 and through 2020 there were multiple protest windows for Members to dispute their seniority ranking. After the 2020 final list no more protests prior to 2020 were considered.
Under the current contract, Article 11 (L), there is language regarding seniority protest procedures. Please be aware of dates and the protest windows, get in the habit of checking your seniority during those times. If you see an error with your seniority as published, reach out to a Shop Steward to file a protest. A Seniority Protest Review Panel is being formed, including TWU Representative, that will review and make a determination if adjustment is necessary. Protest forms will be available beginning February 1, 2023.
FLEET SERVICE JCBA ARTICLE 11 SENIORITY
L. Employees who wish to protest any omission or incorrect posting of their seniority must do so by filing a written grievance within thirty (30) days of the most recent January 31st or July 31st seniority roster. Seniority protests will be strictly confined to errors, changes or omissions which occurred on the most recent seniority posting only. Any employee returning from a leave shall have a period of thirty (30) days from the date of his return to service to file a protest.
M & R (TITLE II) JCBA ARTICLE 11 SENIORITY
L. The Company shall post a seniority list by the last day of January of each year and employees or the Association may protest any omission or error affecting any employee's seniority within thirty (30) days of the current posting. Such lists, published by Group or Classification, will provide, at minimum, the name, employee number, seniority number, Classification seniority date, Company seniority date, job classification, and station of each employee, covered under this Agreement. Any employee on leave at the time of posting will have a period of thirty (30) days from his date of return to service to file a protest.
ATTACHED HERE IS THE LIST FROM 01.31.23, ANY PROTESTS FROM THIS LIST MUST BE SUBMITTED TO THE UNION BY FEBURARY 28, 2023 FOR PROCESSING
